1. Introduction and Scope
This Disclaimer applies to all content, listings, tools, and services made available on PakAutoMart (pakautomart.com), Pakistan's first multi-vendor auto parts marketplace ("PakAutoMart," "the Platform," "we," "us," or "our"), operated from Lahore, Punjab, Pakistan. PakAutoMart operates a multi-vendor marketplace model under which independent, third-party sellers ("Sellers" or "Vendors") list and sell auto parts — including genuine/OEM parts, aftermarket parts, and used or reconditioned parts — directly to buyers ("Buyers" or "Users"). PakAutoMart is an intermediary technology platform that connects Buyers and Sellers. Except where a listing expressly states that PakAutoMart itself is the seller of record, PakAutoMart is generally not the manufacturer, distributor, or seller of the parts listed on the Platform, and does not take physical possession of, inspect, or certify every item sold by Sellers. This Disclaimer should be read together with our Terms & Conditions, Return & Refund Policy, Vendor/Seller Agreement, Anti-Counterfeit & Genuine Parts Policy, and Dispute Resolution Policy. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to the terms of this Disclaimer.
2. Parts Compatibility and Fitment Disclaimer
Auto parts sold on PakAutoMart are frequently vehicle-specific, and correct fitment depends on precise matching of make, model, year, trim, engine variant, chassis number, and, in many cases, production-date ranges that may vary even within a single model year. Listings on the Platform may display compatibility information, fitment guides, part-number cross-references, or the output of VIN/chassis decoding and lookup tools. This information is provided as a convenience only. It is compiled on a best-effort basis, either supplied directly by the Seller or generated using third-party or automated decoding tools, and it is not verified independently by PakAutoMart for accuracy or completeness in every instance.
PakAutoMart makes no representation, warranty, or guarantee, express or implied, that any part listed as "compatible," "fits," or matching a particular vehicle will in fact fit, function correctly, or be suitable for your specific vehicle. Vehicle specifications change across production runs, markets, and modifications, and importers/assemblers in Pakistan may vary configurations from the global standard for a given model. Buyers are solely and directly responsible for independently verifying compatibility before completing a purchase, and again before installation, by: (a) confirming the exact part number, OEM cross-reference, or chassis/engine number with the Seller prior to ordering; (b) consulting the vehicle's owner's manual, workshop manual, or an authorised dealer/workshop; and (c) having a qualified mechanic physically verify fit and function prior to installation, particularly for safety-critical parts, including but not limited to brakes and brake components, steering and suspension components, airbags and restraint systems, and electrical, engine-management, or emissions-control components. PakAutoMart strongly discourages purchasing or installing safety-critical parts based solely on listing descriptions, photographs, or automated fitment tools, without such independent verification.
3. No Liability for Improper Installation or Use
Neither PakAutoMart nor any Seller shall be liable for any damage to a vehicle, personal injury, death, or other loss arising from: (a) incorrect or improper installation of any part purchased through the Platform; (b) use of a part in a vehicle, application, or manner for which it was not designed or intended; (c) failure to follow the manufacturer's or Seller's installation instructions, torque specifications, or safety guidance; (d) installation by unqualified or unlicensed persons; or (e) modification of a part after purchase. Installation of automotive parts, and particularly of safety-critical components such as brakes, steering, suspension, airbags, and engine-management or electrical systems, requires specialised tools, training, and diagnostic equipment. PakAutoMart strongly recommends that all such safety-critical parts be installed only by a qualified, professional mechanic or workshop, and that Buyers request and retain installation and calibration records where applicable. Any decision to self-install a part, or to have it installed by a person or workshop of the Buyer's own choosing, is made entirely at the Buyer's own risk, and PakAutoMart accepts no responsibility for the outcome of that decision.
4. Genuine, Aftermarket, and Used/Reconditioned Parts — Vendor Responsibility
PakAutoMart hosts listings from independent Sellers offering genuine/OEM parts, aftermarket parts, and used or reconditioned parts side by side. The Seller listing each item is solely and primarily responsible for accurately, honestly, and clearly representing the true nature, origin, condition, and authenticity of that part, including whether it is genuine/OEM, aftermarket, or used/reconditioned, and for disclosing any relevant wear, defects, or refurbishment. This obligation, and the consequences of breaching it, are set out in greater detail in our Vendor/Seller Agreement and Anti-Counterfeit & Genuine Parts Policy.
While PakAutoMart undertakes reasonable efforts to screen Sellers, monitor listings, and act on reports of suspected counterfeit, mislabelled, or misrepresented goods, these efforts are reasonable-efforts measures only and do not constitute a guarantee, warranty, or certification that any given part is genuine, authentic, of a particular grade, or accurately described. PakAutoMart does not manufacture, and in most cases does not physically inspect or authenticate, the parts listed by third-party Sellers before sale. Buyers who have concerns about the authenticity or condition of a part, either before or after purchase, should raise these directly with the Seller in the first instance and, if unresolved, escalate the matter through our Dispute Resolution Policy or report suspected counterfeit goods under the Anti-Counterfeit & Genuine Parts Policy.
5. Accuracy of Listing Content
Product titles, descriptions, images, specifications, pricing, stock availability, and compatibility claims displayed on the Platform are provided by the respective Sellers. PakAutoMart does not independently verify, inspect, or endorse the accuracy or completeness of every individual listing before it is published, and listing content may occasionally contain errors, omissions, outdated information, or inaccuracies for which the Seller, not PakAutoMart, bears primary responsibility. PakAutoMart reserves the right, but assumes no obligation, to review, edit, remove, or request correction of listing content that it becomes aware is inaccurate or misleading. Buyers should treat listing content as informational and confirm material details directly with the Seller before purchasing, consistent with Section 2 above.
6. "As-Is" Basis and No Warranty Beyond What Is Stated
Except for any specific written warranty, guarantee, or return right expressly stated by a Seller on a listing, or as expressly provided under our Return & Refund Policy or applicable Pakistani law, all parts are sold on an "as-is" and "as-available" basis, without warranty of any kind, whether express or implied, including any implied warranty or condition of merchantable quality or fitness for a particular purpose. This Disclaimer does not exclude or limit any condition, warranty, right, or liability that cannot lawfully be excluded or limited under the Sale of Goods Act 1930, the Contract Act 1872, or the Punjab Consumer Protection Act 2005, to the extent those statutes apply to the transaction in question. Nothing in this Disclaimer is intended to reduce a Buyer's statutory rights below the minimum protections afforded under applicable Pakistani consumer protection legislation, including that of provinces other than Punjab where a transaction is governed by such other provincial law.
7. External Links and Third-Party Tools
The Platform may contain links to, or embed tools sourced from, third-party websites, VIN/chassis decoders, payment gateways, courier and logistics providers, or other external services. PakAutoMart does not control and is not responsible for the content, accuracy, security, or availability of any third-party website or tool, and the inclusion of any such link or tool does not imply endorsement by PakAutoMart. Use of any third-party website, service, or tool accessed through the Platform is entirely at the User's own risk and subject to that third party's own terms and privacy practices.
8. Use at Your Own Risk
Automotive parts are mechanical and electrical components whose selection, installation, and use carry inherent risks to vehicle safety and occupant safety if handled incorrectly. Your use of the Platform, your reliance on any information displayed on it, and your purchase, installation, or use of any part obtained through it, are undertaken entirely at your own risk. You are responsible for exercising reasonable care and, where appropriate, obtaining professional advice before making purchasing or installation decisions, particularly in respect of safety-critical components as described in Sections 2 and 3 above.
9. Limitation of Liability
To the maximum extent permitted under applicable Pakistani law, PakAutoMart's liability arising out of or in connection with the Platform, any listing, any transaction facilitated between a Buyer and a Seller, or this Disclaimer, is limited as follows: (a) PakAutoMart shall not be liable for indirect, incidental, special, or consequential loss, including loss of profit, loss of use of a vehicle, or towing, storage, or workshop labour charges incurred as a result of a defective, incompatible, or misdescribed part; (b) PakAutoMart's aggregate liability, where liability is established, shall not exceed [LEGAL REVIEW NEEDED]; and (c) primary responsibility for defects, misdescription, and fitness of a part rests with the Seller who listed and sold it, and PakAutoMart's role is that of an intermediary facilitating the transaction, subject to the escalation and dispute mechanisms described in our Dispute Resolution Policy. Nothing in this Section excludes or limits liability that cannot lawfully be excluded or limited under the Sale of Goods Act 1930, the Contract Act 1872, the Punjab Consumer Protection Act 2005, or any other applicable mandatory law.
10. Governing Law and Contact
This Disclaimer is governed by and construed in accordance with the laws of Pakistan, including the Sale of Goods Act 1930, the Contract Act 1872, and, in respect of consumer transactions connected to Punjab, the Punjab Consumer Protection Act 2005, without prejudice to the application of any other province's consumer protection law where a transaction falls within that province's jurisdiction. Any dispute arising out of or in connection with this Disclaimer shall be subject to the dispute resolution process set out in our Dispute Resolution Policy and, failing resolution, to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan.
