1. Introduction and Scope
This Intellectual Property / Copyright Policy ("Policy") explains how intellectual property rights are treated on PakAutoMart, an online multi-vendor marketplace operated in Lahore, Punjab, Pakistan, and accessible at pakautomart.com ("PakAutoMart," "the Platform," "we," "us," or "our"). PakAutoMart describes itself as Pakistan's first multi-vendor auto parts store, connecting independent Sellers with buyers of automotive parts, accessories, and related products. Because the Platform is built around a large catalogue of branded auto parts, questions of trademark and copyright ownership arise constantly and in specific ways that differ from a typical retail website. This Policy sets out: (a) PakAutoMart's own intellectual property; (b) ownership and licensing of content that Sellers upload; (c) the important distinction between lawful, descriptive use of automotive brand names and unlawful counterfeit branding; (d) the process by which rights holders may report suspected infringement; (e) the treatment of buyer-generated content such as reviews and questions; and (f) the general legal framework in Pakistan that underpins this Policy. This Policy should be read together with our Terms & Conditions, our Seller Agreement, our Anti-Counterfeit & Genuine Parts Policy, and our Dispute Resolution Policy, each of which forms part of the overall contractual and policy framework governing use of the Platform.
2. PakAutoMart's Own Intellectual Property
The PakAutoMart name, the PakAutoMart logo, the look and feel of the website and mobile interfaces, the underlying software, source code, databases, catalogue structure, search and recommendation systems, and all original text, graphics, and branding created by or for PakAutoMart (collectively, "PakAutoMart Materials") are the property of PakAutoMart and are protected under applicable Pakistani law, including the Copyright Ordinance 1962 and the Trade Marks Ordinance 2001, as well as under general principles of unfair competition and passing-off. No person or entity may copy, reproduce, republish, frame, mirror, scrape, reverse-engineer, or create derivative works from the PakAutoMart Materials, or use the PakAutoMart name or logo in a manner that suggests endorsement, affiliation, or sponsorship, without our prior written consent. Sellers and other third parties are permitted to reference "PakAutoMart" only to accurately describe their presence on the Platform (for example, "Available on PakAutoMart") and not in a way that implies a broader partnership than actually exists.
3. Ownership of Seller-Uploaded Content
PakAutoMart operates as a multi-vendor marketplace. Independent Sellers who register on the Platform are responsible for creating and uploading their own product listings, including product photographs, titles, descriptions, specifications, and related marketing copy ("Listing Content"). As between a Seller and PakAutoMart, the Seller retains ownership of all Listing Content that it originates and uploads, including any underlying copyright in original photographs or written descriptions that the Seller itself created.
By uploading Listing Content to the Platform, a Seller grants PakAutoMart a non-exclusive, worldwide, royalty-free, sub-licensable license to host, store, reproduce, display, distribute, adapt (for example, to resize images or reformat text for different devices), translate, and otherwise use that Listing Content for the purposes of operating, promoting, and improving the Platform. This license includes the right for PakAutoMart to display Listing Content across its website, mobile applications, email communications, and marketing channels (including social media and search advertising), and to permit search engines and other authorized partners to index and display it. This license survives for as long as the relevant listing remains on the Platform and for a reasonable period thereafter for archival, evidentiary, and legal-compliance purposes, but does not transfer ownership of the underlying content away from the Seller. Sellers remain solely responsible for ensuring that they hold sufficient rights in any Listing Content they upload, including any photographs sourced from manufacturers, distributors, or third parties, and must not upload content that infringes the copyright, trademark, or other rights of any third party.
4. Auto-Parts Brand Names: Lawful Descriptive Use vs. Prohibited Misuse
A defining feature of an auto parts marketplace is that the overwhelming majority of products sold are genuine, branded items manufactured by third parties such as Denso, Bosch, NGK, Toyota, Honda, and numerous other original equipment manufacturers and aftermarket brands. It is normal, expected, and lawful for Sellers to use these brand names and trademarks in product titles, descriptions, and search filters where doing so accurately identifies a genuine product being offered for sale. This kind of use — sometimes referred to as "nominative" or descriptive use of a trademark — exists to help buyers find and correctly identify the specific genuine part they need (for example, "NGK Spark Plug for Honda Civic 2016-2020" or "Genuine Bosch Brake Pad Set"). PakAutoMart does not consider this ordinary descriptive use of a trademark to constitute infringement, provided that: (a) the product being described is genuinely manufactured by, or genuinely bears the mark of, the named brand owner; (b) the use does not falsely suggest that the Seller or PakAutoMart is the brand owner, an authorized distributor, or otherwise affiliated with the brand owner beyond what is actually true; and (c) the use is no more than reasonably necessary to identify the genuine product.
By contrast, it is strictly prohibited for any Seller to use a brand name or trademark to describe, title, tag, or otherwise mislabel a product that is not genuinely manufactured or authorized by that brand owner. Listing a counterfeit, replica, "copy," or unauthorized part while using a genuine brand's name, logo, or model numbers to suggest that it is authentic is a serious violation of this Policy, of applicable trademark law, and of consumer-protection principles, regardless of whether the Seller discloses elsewhere that the item is a copy. This conduct is addressed in detail, together with our verification, reporting, and enforcement measures for counterfeit and unauthorized-brand listings, in our separate Anti-Counterfeit & Genuine Parts Policy, which should be read as an integral part of PakAutoMart's overall intellectual property compliance framework. Rights holders concerned specifically about counterfeit goods bearing their marks should refer to that policy in addition to the takedown process described below, as the two processes are closely related and may be pursued together.
5. Reporting Suspected Infringement: Notice-and-Takedown Process
PakAutoMart respects the intellectual property rights of others and expects Sellers and users to do the same. We have adopted a notice-and-takedown process modeled on internationally recognized best practices for online platform takedown requests (of the kind commonly associated with "DMCA-style" procedures used by major e-commerce and internet platforms worldwide), adapted for use on PakAutoMart. This process is a practical mechanism for rights holders to report suspected infringement to us; it is not a representation that Pakistani law contains a statute identical to the U.S. Digital Millennium Copyright Act, and the underlying legal rights being enforced remain governed by Pakistani law, including the statutes referenced in Section 7 below.
Any person who believes that a listing on PakAutoMart infringes their copyright or trademark, or that a listing misuses a genuine brand name to describe a counterfeit or unauthorized product, may submit a written takedown request to admin@pakautomart.com. To allow us to investigate and act efficiently, a takedown request should include, at minimum:
- Identification of the copyrighted work or registered/unregistered trademark claimed to have been infringed, including registration details where available;
- The exact URL(s) or listing identification number(s) on pakautomart.com where the allegedly infringing material appears;
- The full name, contact details, and, where applicable, the company or organization of the complainant, and their relationship to the rights holder (owner, licensee, or authorized agent);
- A clear statement explaining why the listing is believed to infringe the relevant right (for example, unauthorized use of copyrighted images, unauthorized use of a registered trademark, or a genuine brand name being used to mislabel a counterfeit product);
- A good-faith statement that the complainant reasonably believes the use is not authorized by the rights holder, its agent, or the law; and
- A physical or electronic signature, or equivalent identification, of the complainant or their authorized representative.
Upon receiving a complete and valid takedown request, PakAutoMart will review the complaint, may temporarily suspend or remove the reported listing pending investigation, and will notify the relevant Seller of the complaint. Where appropriate, we may request supporting documentation from either party before making a final determination. We aim to acknowledge takedown requests promptly and to act on well-founded requests without undue delay, though response times may vary depending on the complexity of the claim.
A Seller whose listing has been removed or suspended as a result of a takedown request may submit a counter-notice to admin@pakautomart.com if the Seller believes the listing was removed in error or as a result of misidentification — for example, where the Seller can demonstrate that the product is genuine, that it holds the necessary rights or authorization, or that the complaint was factually mistaken. A counter-notice should identify the listing in question, explain the basis for believing the removal was in error, and include supporting evidence such as invoices, authorization letters, or distributorship agreements. PakAutoMart will review counter-notices in good faith and may reinstate a listing where the evidence supports the Seller's position, or refer the matter for further review, including under our Dispute Resolution Policy, where the parties dispute the underlying facts.
PakAutoMart maintains a repeat-infringer policy for Sellers. A Seller who is the subject of multiple validated infringement complaints, or repeated confirmed instances of counterfeit or unauthorized-brand listings, will face escalating consequences, which may include mandatory removal of the affected listings, suspension of the Seller's ability to list further products in the relevant category, temporary suspension of the Seller's account, or permanent termination of the Seller's account, in accordance with the Seller Agreement. PakAutoMart reserves the right to take these steps at its discretion where it reasonably believes a pattern of infringing or counterfeit conduct exists, even in the absence of a formal takedown request for every individual instance.
6. User-Generated Content: Reviews and Questions
Buyers who post product reviews, ratings, questions, answers, comments, or similar content on the Platform ("User Content") retain ownership of the original text and any images they personally create and upload as part of that User Content. By submitting User Content, a buyer grants PakAutoMart a non-exclusive, worldwide, royalty-free, perpetual, and sub-licensable license to host, reproduce, display, distribute, and adapt that User Content in connection with operating and promoting the Platform, including displaying reviews alongside product listings, aggregating ratings, and using excerpts in marketing materials. Buyers must not submit User Content that infringes the copyright or trademark of any third party, that is defamatory, or that misappropriates another person's images or written work. PakAutoMart reserves the right to remove or edit User Content that violates this Policy, our Terms & Conditions, or applicable law, and to respond to valid takedown requests concerning User Content using the same process described in Section 5.
7. Legal Framework in Pakistan
This Policy operates against the background of Pakistani intellectual property law, which generally protects copyright in original literary, artistic, and other creative works under the Copyright Ordinance 1962, and protects registered and, to a more limited extent, unregistered trademarks under the Trade Marks Ordinance 2001. Pakistan also participates in the international intellectual property framework applicable to member states generally, which informs the general expectation that trademark and copyright rights recognized abroad are given appropriate weight domestically. 8. Changes to This Policy and Contact
PakAutoMart may update this Policy from time to time to reflect changes in our practices, the marketplace, or applicable law. The version number and "Last Updated" date at the top of this page indicate the current version. Continued use of the Platform after changes are posted constitutes acceptance of the revised Policy.
