These Terms & Conditions ("Terms") govern access to and use of PakAutoMart (pakautomart.com), described and operated as Pakistan's first multi-vendor auto parts store and online marketplace ("PakAutoMart," "we," "us," or "the Platform"). By creating an account, browsing listings, placing an order, or otherwise using the Platform, you ("User," "Buyer," or "you") agree to be bound by these Terms, our Privacy Policy, our Return & Refund Policy, our Disclaimer, and, where applicable, our Dispute Resolution Policy. If you do not agree to these Terms, you must not use the Platform.
1. Acceptance of Terms
Use of PakAutoMart constitutes an electronic acceptance of these Terms within the meaning of the Electronic Transactions Ordinance 2002, which recognises the legal validity of electronic documents, electronic records, and electronic signatures in Pakistan. Your continued use of the Platform after any update to these Terms constitutes acceptance of the revised Terms. These Terms constitute a contract governed generally by the principles of offer, acceptance, and consideration under the Contract Act 1872, read together with the Sale of Goods Act 1930 in respect of the sale of goods listed by Sellers on the Platform.
2. Eligibility and Account Registration
To place orders on PakAutoMart, you must be at least eighteen (18) years of age and capable of entering into a legally binding contract under the Contract Act 1872. Users under this age may use the Platform only under the supervision of a parent or legal guardian who agrees to these Terms on their behalf. When registering an account, you agree to provide accurate, current, and complete information, including your name, contact number, delivery address, and a valid email address, and to keep this information updated. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You must notify us immediately at admin@pakautomart.com if you suspect unauthorized use of your account.
3. PakAutoMart's Role as a Marketplace Platform
It is essential that Users understand the structure of PakAutoMart's business model before transacting on the Platform. PakAutoMart operates a multi-vendor marketplace. The majority of auto parts listed on the Platform — whether genuine/OEM, aftermarket, or used/reconditioned — are listed and sold by independent third-party vendors ("Sellers") who operate their own storefronts under a separate Vendor/Seller Agreement with PakAutoMart. Except where PakAutoMart explicitly identifies itself as the direct seller of a specific listing, PakAutoMart is not the seller of record for products listed by Sellers. PakAutoMart's role in respect of such listings is that of an intermediary technology platform that facilitates product discovery, listing hosting, order placement, and, for certain orders, coordination of payment collection and logistics/delivery on behalf of Sellers.
Consequently, the contract of sale for any product listed by a Seller is formed directly between the Buyer and that Seller. PakAutoMart is not a party to that contract of sale, does not manufacture or, in most cases, physically stock the products listed by Sellers, and does not independently verify every representation a Seller makes about a listing's condition, authenticity, fitment, or compatibility, although Sellers are contractually required under the Vendor/Seller Agreement to list products accurately and lawfully. Buyers should review our Disclaimer for further detail on the limits of PakAutoMart's role, and our Return & Refund Policy for how returns, refunds, and exchanges are handled between Buyers, Sellers, and PakAutoMart depending on the order type.
4. User Obligations and Prohibited Conduct
By using PakAutoMart, you agree that you will not: (a) provide false, misleading, or fraudulent information when registering an account or placing an order; (b) use the Platform for any unlawful purpose or in a manner that violates the Prevention of Electronic Crimes Act (PECA) 2016, including unauthorized access to any account or system, data interference, electronic fraud, or identity theft; (c) attempt to circumvent the Platform's payment or order systems to transact directly with a Seller in a manner that avoids applicable fees or protections; (d) post false reviews, harass Sellers or other Users, or upload content that is defamatory, obscene, or infringes the rights of any third party; (e) scrape, reverse-engineer, or interfere with the technical operation of the Platform; or (f) misuse the Platform to list, request, or attempt to purchase counterfeit, stolen, or unlawfully sourced auto parts. Violations may result in suspension or termination of your account and may be reported to the relevant law enforcement or regulatory authorities under applicable Pakistani law.
5. Orders and Contract Formation
When you place an order on PakAutoMart, you are making an offer to purchase the listed product(s) from the relevant Seller (or from PakAutoMart directly, where PakAutoMart is expressly the seller of record) at the listed price. A contract for sale is concluded only upon confirmation of the order, which may occur through an automated order confirmation, Seller acceptance, or dispatch of the product, as specified at checkout. PakAutoMart reserves the right, and Sellers reserve the right, to cancel an order prior to dispatch in cases of pricing errors, stock unavailability, suspected fraud, or failure of payment verification, in which case any amount paid will be refunded in accordance with the Return & Refund Policy. Product descriptions, images, specifications, and fitment information are provided by Sellers (or, for Platform-listed inventory, by PakAutoMart) and should be independently verified by the Buyer against their vehicle's specifications before purchase, particularly for parts where fitment is safety-critical.
6. Pricing and Payments
All prices displayed on PakAutoMart are stated in Pakistani Rupees (PKR) only. Any prices shown elsewhere for illustrative purposes are indicative examples only and do not represent live or binding pricing. Prices may include or exclude applicable taxes and delivery charges, which will be disclosed at checkout; the applicable tax treatment and rates are subject to prevailing Pakistani tax law and are confirmed at the time of transaction [LEGAL REVIEW NEEDED — exact applicable tax rates and treatment to be confirmed with a tax advisor and stated precisely once finalized]. PakAutoMart facilitates payment collection for certain orders using the payment methods made available on the Platform, including cash-on-delivery and electronic payment options, and may pass on collected amounts to Sellers in accordance with the Vendor/Seller Agreement. Sellers remain responsible for the accuracy of the prices they list. In the event of an obvious pricing error (for example, due to a technical glitch), PakAutoMart or the relevant Seller reserves the right to cancel the affected order and issue a full refund.
7. Consumer Protection
Because PakAutoMart's registered business address is in Lahore, Punjab, the Punjab Consumer Protection Act 2005 is the primary consumer protection framework applicable to transactions on this Platform. Buyers located in other provinces may additionally hold rights under their own provincial legislation, such as the Sindh Consumer Protection Act 2014 or the Islamabad Consumer Protection Act 1995, as applicable to their location. Users should note that Pakistan does not currently have a single unified federal consumer protection statute, and consumer protection in Pakistan is presently governed at the provincial and territorial level. Nothing in these Terms limits any statutory right a consumer may hold under the applicable provincial law.
8. Account Suspension and Termination
PakAutoMart may suspend, restrict, or terminate a User's account, with or without prior notice, where we reasonably believe the User has: breached these Terms or any incorporated policy; engaged in fraudulent, abusive, or unlawful conduct; provided false registration information; repeatedly failed to complete or unjustifiably disputed legitimate orders; or posed a risk to the security, integrity, or reputation of the Platform, its Sellers, or other Users. Users may close their own account at any time by contacting admin@pakautomart.com, subject to settlement of any pending orders or payment obligations. Termination does not affect any rights or obligations that accrued prior to termination, including obligations relating to completed or pending orders.
9. Intellectual Property
The PakAutoMart name, logo, website design, and underlying software are the intellectual property of PakAutoMart and may not be copied, reproduced, or used without prior written consent. Sellers retain ownership of their own brand names, trademarks, and content, subject to the license they grant PakAutoMart under the Vendor/Seller Agreement to display such content on the Platform. Users concerned about the authenticity of parts listed on the Platform should also refer to our Anti-Counterfeit & Genuine Parts Policy.
10. Limitation of Liability
To the maximum extent permitted under applicable Pakistani law, PakAutoMart's liability arising from your use of the Platform is limited as follows. Because PakAutoMart acts as an intermediary marketplace for Seller-listed products, PakAutoMart shall not be liable for: defects, misrepresentation, or non-conformity in a product listed and sold by a Seller; delays or failures in delivery caused by a Seller or third-party logistics provider; or any indirect, incidental, or consequential loss arising from a transaction between a Buyer and a Seller. Where PakAutoMart is itself the seller of record for a listing, its liability is limited to the remedies available under the Sale of Goods Act 1930 and the applicable provincial consumer protection law, and, in any event, shall not exceed the amount actually paid by the Buyer for the relevant order. This limitation does not exclude liability that cannot lawfully be excluded under Pakistani law. Further disclaimers applicable to Platform use are set out in our Disclaimer.
11. Indemnification
You agree to indemnify and hold harmless PakAutoMart, its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal costs) arising out of or connected to: your breach of these Terms; your violation of any applicable law, including PECA 2016; your infringement of any third-party right; or any dispute between you and a Seller arising from a transaction conducted through the Platform.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Subject to the escalation and resolution steps described in our Dispute Resolution Policy, any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan [LEGAL REVIEW NEEDED — specific competent court/forum and, if applicable, any designated arbitration institution and rules to be confirmed by counsel and inserted here].
13. Changes to These Terms
PakAutoMart may revise these Terms from time to time to reflect changes in our services, business practices, or applicable law. Where changes are material, we will endeavour to provide notice via the Platform or by email to the address on your account. The "Last Updated" date at the top of this page indicates when these Terms were last revised. Continued use of the Platform following any such update constitutes your acceptance of the revised Terms.
